What does “not apply to the uniform of decks mean”? (URGENT)?
I built a deck – and received a notice that it states my deck does not apply to the uniform of decks. (I received permission from the Board and retrieved the proper permits)
FYI – I live in a TownHouse….. There are two types of decks. Low to the ground and one that is 5 feet up. Mine is 5 feet up.
Now they are saying, they didn’t see the portion on the design where my corner will be 6 feet high. Mind you, I’m not blocking anyones view from anything. The only thing between me and my neighbors are huge trees.
1) All the decks are different shapes and sizes where I live
2) The people who live on the lake have two decks (not one)
3) Some people have two cement stairs and no deck
4) All the decks are either stained or painted
5) A lot of the decks are out of code
7) Some people don’t even have a deck or patio
With that said, about all the other decks they want me to remove it – yet it cost 15,000 to put up.
NOW WHAT?
Assuming the plans clearly show the 6 foot height then I agree with Poorboy. It is not your responsibility to read the plans for the Board. That is their responsibility. If they approved the plans and you acted in good faith based on that approval, they could be responsible for any cost to correct the problem.
I have found that it is amazing what a lawyer can do when they are present for a discussion.
